Terms of Service

Age requirement

Fresh Bloom is intended for users who are at least 17 years old. The app contains user-generated photos and shares real-world locations, so it is not directed to children. By using signed-in community features you confirm you are at least 17 and old enough to agree to these Terms in your country. Fresh Bloom does not knowingly collect data from anyone under 13; if you believe a child has provided us data, email support@freshbloom.app and we will delete it.

Using Fresh Bloom

• Post only real bloom photos you have the right to share.
• Do not upload fake, misleading, harmful, illegal, private, or abusive content.
• Do not spam uploads, reactions, reports, feedback, account creation, or support flows.
• Respect public paths, private property, protected areas, and local rules.

Your content

You keep ownership of your photos and text. You give Fresh Bloom permission to store, display, resize, cache, moderate, and share your posted content as needed to operate the app.

Moderation and safety

Fresh Bloom may hide, delete, limit, or review content or accounts that appear unsafe, abusive, spammy, misleading, or costly to operate. Reports, blocks, account deletion requests, and payment/safety records may be retained where needed.

Optional support

Support Fresh Bloom purchases are optional and do not unlock ranking, visibility, moderation priority, or safety privileges. Core community rules apply equally to everyone.

Contact

Use Feature Request and Feedback in the app for bugs, feature ideas, account deletion questions, safety concerns, and moderation appeals. If you cannot access the app, email support@freshbloom.app.

Availability

Fresh Bloom is provided as available. Features may be limited during maintenance, outages, cost-protection mode, moderation actions, or provider issues.

Outdoor safety and assumption of risk

Fresh Bloom shows user-submitted locations and does not verify that any place is accurate, public, accessible, open, or safe to visit. Going outdoors to view blooms is entirely at your own risk. You are responsible for your own safety, for obeying laws and posted rules, for not trespassing on private property, and for not picking, damaging, or removing protected plants or wildlife. To the maximum extent permitted by law, Fresh Bloom Software LLC are not liable for any injury, loss, damage, encounter, citation, or harm arising from visiting, traveling to, or relying on any location, route, or post in the app.

Disclaimer of warranties

To the maximum extent permitted by law, Fresh Bloom is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement. Fresh Bloom does not warrant that the app will be uninterrupted, secure, error-free, or that any content or location is accurate or reliable.

Limitation of liability

To the maximum extent permitted by law, Fresh Bloom Software LLC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or other intangible losses, arising from or related to your use of the app. The total aggregate liability for all claims relating to the app will not exceed the greater of the amount you paid Fresh Bloom in the 12 months before the claim or USD $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Fresh Bloom Software LLC from and against any claims, damages, liabilities, losses, and reasonable legal fees arising from your content, your use of the app, your violation of these Terms or any law, or your infringement of any third party's rights, including privacy and intellectual property rights.

Photos of people and private property

Only upload photos you have the right to share. Do not upload photos that identify other people, their homes, or private property in a way that could expose, locate, or endanger them without permission. Use Approximate for homes, backyards, and sensitive spots. If you appear in a photo or believe a post exposes your private location, email support@freshbloom.app and we will review and remove it where appropriate.

Copyright and DMCA

Fresh Bloom respects intellectual property rights. If you believe content infringes your copyright, send a notice to support@freshbloom.app with the work, the infringing post, your contact details, a good-faith statement, and a statement under penalty of perjury that you are authorized to act. We may remove reported content and may remove repeat infringers. A user whose content was removed may submit a counter-notice using the same contact.

Prohibited conduct and zero tolerance

There is zero tolerance for objectionable content or abusive users. Do not upload explicit, violent, hateful, harassing, illegal, deceptive, or privacy-violating content, and do not abuse, scrape, attack, or interfere with the app or other users. You can report or block content and users in the app. We aim to review reports of objectionable content and remove violating content and the responsible users within 24 hours.

Apple App Store terms

If you obtained Fresh Bloom from the Apple App Store, these Terms are between you and Fresh Bloom Software LLC, not Apple, and Apple is not responsible for the app or its content. Your use is also subject to Apple's standard Licensed Application End User License Agreement (apple.com/legal/internet-services/itunes/dev/stdeula). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Termination

Fresh Bloom Software LLC may suspend, limit, or terminate your access or remove content at any time if you violate these Terms or to protect users, the community, or app operation. You may stop using the app and delete your account at any time.

Changes, governing law, and disputes

Fresh Bloom may update these Terms; material changes are re-prompted in the app, and continued use after an update means you accept the new version. These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules, and you and Fresh Bloom Software LLC agree to the exclusive jurisdiction of the state and federal courts located in Texas, except where applicable law gives you a non-waivable right to your local courts. If any provision is unenforceable, the rest remains in effect.
